John, thanks for posting.

I am not against rallying, I have done some many years ago.  But I am
concerned at competitive events on unsurfaced roads esp. BOATS & RUPPS
where the rights to use them are so fragile.  Speed is invariably a factor,
and night rallying would inflame a delicate situation. When fighting for
byway status of rupps we always hear of "racing up and down ancient tracks"
   Where 4 vehicles might be tolerated 30 or more rally cars might not.  
The unsurfaced roads are often in a state where only more rugged vehicles
can use them, and that is what they have been like for centuries.  Within
reason I do not see anything wrong with this.  They are also variable with
weather and farming activity so what might be ok when planning a route is
impassable on the event.   That is the nature of these roads, and the
character should not be changed to make them too flat and characterless, or
they will go the same as so many others ending up with a bitumen surface. 
It you have some specific examples we might be able to form an informed
consensus.

Another aspect is that use has to be made of these ways, otherwise they
will be closed down (S116).  Bucks tried it with 7, and gave up when they
had 70 letters of objection.  Hereford & Worcester are trying it with 10
"Little Used Roads" now and 130 more to follow.  HA rang me this am. (They
seem quite concerned that I was about to put in BOAT applications on them) 
 Our difficulty is there are only a small number of people that want  to
use the ways.  We need all the use of these we can get, some are suitable
for 2wd, some have been totally obstructed, -  one has a lake built on it! 
  It seems the only way is for a large number of people to object to the
downgrading and say they are prepared to say so in court, to prevent it
ever going that far.

Obstructions are a big problem as some HAs do not want to uphold the law. 
Give details,  and there is strength in numbers.  Direct Action, within the
law, is far quicker and more effective on many obstructions.

Yes, there is help available. LARA offers that help, through me, and would
welcome more support from the competitive motoring groups in the protection
of rights of way. In particular, I know that many groups like yours have been
using whites, etc for many years, but how many times have you put this
evidence on the table at Public Inquiries?

Regarding obstructions, they should be reported to the Highway Authority and
the Police, and you should insist on the obstruction being recorded
officially, and acted on. Obstruction of the highway is a serious offence and
should not be treated lightly by anyone. Have you any policemen in your group
who might advise on how to get the best from the system?
If the road is 'out of repair' there is a different procedure in HA 80 s56 to
get this put right. I can advise if needed.

Are you in touch with your local LARA respondent who acts per pro the ACU in
responding to changes in the RoW network?

Is your club represented on any local liaison groups with the HA, other
users, landowners, etc?

If you let me have more specific details of the routes you cannot use, I can
offer more useful advice.
