Hi Owen,
Under Scottish Law the biggest problem you have is if a permanent=
obstruction or TRO is achieved with this scheme. Closure of roads for 20=
years in Scotland means automatic extinguishment.
However I believe you can immediately retry to re-establish the right of
way by using it again.
You need to see who is involved, and look for ulterior motives for the
closure. Once you have that, you need to make a personal legal challenge =
on
the involved people. I don't know if the same law applies as England but =
we
use misplaced philanthropy to very powerful effect.
We say that if the people involved want to impose their personal ideas,
they will have to pay for the privilege and possibly face criminal
proceedings. It has worked every time so far.
Find out what rules the involved people have to work to and then see how
those rules can be used to control the actions of those people.
