I hear the Co Sec/Sol has summoned her highways director Gareth Randell, (who never replies to letters) and legal and RoW (I think) to a meeting on 20th. I would like to be a fly on the wall. But she is reported to say this is getting out of hand, it's got to be sorted. Even the very patient Mr B. has after 10 years, put in a complaint that they have not made an order. Mr A from Brampton Bryan has asked some 'direct' questions. Even the Nice Mr G from Malvern has asked for a reply. I think they know they have some explaining to do. They have been taking the micky too long, now they are running scared. And we are loving it. Must remind the Audit commission I have not heard from their auditors. Don't you just love it when you got sommat yer can get yer teef inta? I expect a fone call about Wednesday........ I know I could go to ombudsman now, but we will get further if we can sit them down at a table and give them a good talking to. (There's modesty!) I'll keep you posted. From: Mike Thomas <miket@rmtmhs.demon.co.uk> Date: Sat, 09 Jan 1999 19:18:46 +0000 Subject: Dere Street conversion I have just got hold of a copy of the notice from the Scottish Border Council: Town and Country Planning (Scotland) Act 1997 The Scottish Borders Council (Conversion of a portion of Dere Street from Pennymuir to Whitton Edge) Order 1998 The Scottish Borders Council hereby give notice that they have made an Order under Section 203 of the Town and Country Planning (Scotland) Act 1997 authorising the conversion of:- That section of Dere Street from the C41 at Pennymuir in a north westerly direction for a length of 5.2km or thereby to the unclassified road D140.4 near Whitton Edge to a bridleway and a footpath (with a right for pedal cycles) but including provision for (1) permitting the continued use on the road by vehicles (whether mechanically propelled or not) for agricultural purposes and for the purpose of and maintaining and repairing the bridleway and footpath and (2) maintaining the existing rights of statutory undertakers. Copies of the proposed Order and relevant plan specifying the length of highway to be converted may be inspected at the Council Headquarters, of the Scottish Borders Council, Newtown St. Boswells, Melrose, TD6 0SA by any person free of charge, between the hours of 9.00am and 4.00pm weekdays, during a period of 28 days from 24 December 1998. A further copy of the documents are also available for inspection at Jedburgh Public Library during normal opening hours. Within that period any person may object to the making of the Order by notice in writing addressed to the Scottish Borders Council, Director of Central Services, Council Headquarters, Newtown St. Boswells. Objections should state the name and address of the objector, the matters of which they relate and the grounds on which they are made. On expiry of that period for objections the Order will be submitted to the Secretary of State for Scotland for consideration of any objections and confirmation or confirmed by the Scottish Borders Council as an unopposed order if there are no objections. The CC should get in with a charge under HA80 of obstruction, continuous obstruction, for the barn, and one under the bits to do with barbed wire (some of which is used in blocking off the FP) - then let the LO do the squealing!!! Having done him for that find the most expensive contractor to remove the obstructions, and send the bill, with a suitable CC 'administrative overhead' to the LO, along with a foreclosure notice to make his day :-) At the same time establish the 'diversionary route', just in case he decides to re-establish the barn and fence.... I'm not vindictive I just HATE that sort of LO. It means that someone attached more then one file to an email and then sent it to AOL. AOL encodes all the attachments (like a zip but different ) and forwards them to you. If you search AOL for keyword MIME, I think they give you the decoding program. From what I can remember Owen saying about the Scottish situation much of it is entrenched in what might be termed 'common law' and 'case law' rather than 'statue law'. Much more emphasis is placed on use, and continued use than down here. The lower court in Scotland is the Sheriff's Curt, similar to, but different from the English & Welsh Magistrates' Court.
